Please be advised that all vessel owners are required to submit a copy of their current insurance policy prior to their vessel's initial entry into the marina. Additionally, updated documentation must be provided annually on the anniversary of the policy. The insurance must provide a minimum of $10 million in public liability coverage.

Maintenance, Safety and Temporary Relocation

The Member acknowledges that pursuant to Clause 27 of the Constitution

the Directors are responsible for the management, maintenance, safety, risk control and ongoing operation of the Marina, Marina Assets and Marina Common Areas.

The Member further acknowledges that Outgoings levied under Clause 62 of the Constitution

include maintenance, repair and replacement works, and that such works may from time to time affect access to or use of a Marina Berth.

Where, in the reasonable opinion of the Directors, it is necessary to undertake inspection, maintenance, repair, replacement, reconstruction, emergency works or other works affecting a Marina Berth or marina arm, the Directors may:

(a) suspend access to the relevant berth;
(b) require the temporary relocation or removal of a vessel;
(c) restrict access to portions of the Marina.

The Member must comply promptly with any reasonable direction issued by the Directors or authorised agents of the Club to relocate or remove a vessel to enable such works to be undertaken safely and efficiently.

The Club will use reasonable endeavours to provide an alternative berth within the Marina during any period of suspension; however, the Member acknowledges that:

(a) the Club does not guarantee the availability of an alternative berth or storage location; and
(b) availability will depend on operational and safety considerations affecting the Marina as a whole.

If no alternative berth is available, the Member is responsible for arranging and bearing the cost of temporary relocation, storage or alternative mooring of their vessel.

Except to the extent caused by negligence or wilful misconduct of the Club, the Club shall not be liable for any loss of use, inconvenience, business interruption, relocation costs or consequential loss arising from maintenance works, safety restrictions or the temporary unavailability of a berth.

This clause operates consistently with the Member’s obligation under Clause 43.3 of the Constitution

This application is subject to AYC directors approval, you should receive an approval via email within 10 days.
